GENERAL RENTAL CONDITIONS – BLUE VIBES
BONAIRE

These General Rental Conditions apply to all reservations and rental agreements relating to vacation homes offered by Blue Vibes Bonaire.
In these General Rental Conditions, “Tenant” means the natural person who enters into a rental agreement with Blue Vibes Bonaire regarding the rental of a vacation home.
These conditions apply to the exclusion of any terms or conditions referred to or used by the Tenant. Any such terms are expressly rejected.
Deviations from these conditions are only valid if agreed upon in writing by Blue Vibes Bonaire.
Article 1 – Reservations and Formation of the Agreement
1.1 Reservations are accepted exclusively from persons aged 23 years or older. Reservations made by persons under this age are not valid.
1.2 Blue Vibes Bonaire reserves the right to refuse a reservation at any time and without stating reasons.
1.3 After a reservation has been made, the Tenant will receive a confirmation, these General Rental Conditions and an invoice within one (1) day.
1.4 The Tenant is required to check all received documents for accuracy and to report any inaccuracies immediately in writing.
1.5 If the Tenant has not received a confirmation within one (1) day after making the reservation, the Tenant must contact Blue Vibes Bonaire immediately. Failure to do so will result in the reservation being cancelled without further claim.
1.6 The rental agreement is concluded once Blue Vibes Bonaire has confirmed the reservation in writing. The agreement concerns the rental of a vacation home for recreational use of a temporary nature.
Article 2 – Payment
2.1 Payments must be made through the website of Blue Vibes Bonaire, by bank transfer or credit card.
2.2 At the time of booking, 50% of the total rental amount must be paid.
2.3 The remaining 50% must be paid no later than 45 days prior to arrival.
2.4 If the reservation is made within 45 days prior to arrival, the full rental amount must be paid immediately at the time of booking.
2.5 By making a partial or full payment, the Tenant confirms having read and agreed to these General Rental Conditions.
2.6 The rental agreement terminates by operation of law after expiration of the agreed rental period.
2.7 Any costs charged by banks, credit card companies or payment providers, including
transaction or exchange rate fees, shall be borne entirely by the Tenant.
Article 3 – Travel Insurance
3.1 The Tenant is expressly advised and deemed to take out an adequate travel and cancellation insurance, covering inter alia cancellation, illness, accident, death, travel restrictions and other unforeseen circumstances.
3.2 The absence of sufficient insurance is entirely at the Tenant’s own risk and can never be transferred to Blue Vibes Bonaire.
3.3 Circumstances normally covered by travel or cancellation insurance do not entitle the Tenant to deviation from these rental conditions.
Article 4 – Modifications to the Booking
4.1 Requests for changes after conclusion of the agreement must be submitted in writing.
4.2 Blue Vibes Bonaire is under no obligation to accept any requested changes and may decide at its sole discretion.
4.3 Changes within four (4) weeks prior to arrival are, in principle, not possible.
4.4 Any change resulting in a different stay period shall be regarded as a cancellation followed by a new booking, to which the cancellation provisions of these General Rental Conditions apply.
Article 5 – Cancellation, Rebooking and Goodwill Arrangements
5.1 Cancellation by the Tenant must be made in writing by e-mail and is deemed received on the date confirmed by Blue Vibes Bonaire.
5.2 In case of cancellation 45 days or more prior to arrival, the Tenant is entitled to a refund of 50% of the amount already paid.
5.3 In case of cancellation within 45 days prior to arrival, on the day of arrival or thereafter, 100% of the rental amount is due. Paid amounts will not be refunded.
5.4 Failure to arrive within 24 hours after the agreed arrival date without notice (“no-show”) is regarded as a cancellation, and 100% of the rental amount remains due.
5.5 Partial payments or deposits are never fully refundable, unless explicitly agreed otherwise in writing.
5.6 A request to cancel and move the stay to another period is considered a cancellation followed by a new booking.
5.7 Blue Vibes Bonaire may, at its sole discretion and as a goodwill gesture, convert paid amounts into a booking credit, which:
- is personal and non-transferable;
- is not exchangeable for cash;
- may only be used by the same Tenant;
- cannot be combined with discounts or promotions;
- must be used within a period determined by Blue Vibes Bonaire;
- is settled against the rates applicable at the time of the new booking.
5.8 In the event of cancellation due to the death of the Tenant or a direct family member (partner, parent or child), Blue Vibes Bonaire may deviate from the cancellation policy as a goodwill gesture.
5.9 Blue Vibes Bonaire may require written proof to apply this goodwill arrangement.
5.10 In case of cancellation by Blue Vibes Bonaire, other than due to attributable failure by the Tenant, all paid amounts will be fully refunded.
Article 6 – Keys and Access
6.1 The key to the vacation home is provided on loan and remains the property of Blue Vibes Bonaire.
6.2 In case of loss, theft or damage of the key, the Tenant owes a fee of USD 25.
6.3 In case of lock-out, a fee of USD 25 will also be charged.
Article 7 – Stay and Use of the Vacation Home
7.1 Check-in is from 16:00 on the day of arrival. Check-out must take place no later than 10:00 on the day of departure.
7.2 All vacation homes are non-smoking. Smoking is permitted only outside.
7.3 The use of open fire, including charcoal barbecues, is not permitted.
7.4 Pets are not allowed.
7.5 Water and electricity are included in the rental price; however, the Tenant is kindly requested to use utilities responsibly.
7.6 Occupancy by more persons than agreed or exceeding the maximum allowed number is prohibited and may result in immediate termination of the agreement without refund.
7.7 Furniture may not be moved and indoor inventory may not be taken outside, except for glasses and cutlery.
7.8 Tenants and co-users must avoid excessive noise or nuisance to neighbors. Serious or repeated disturbance may result in immediate termination without refund.
Article 8 – Unforeseen Circumstances
8.1 Unforeseen Circumstances means any situation beyond the reasonable control of Blue Vibes Bonaire which prevents, temporarily or permanently, the full or partial performance of the rental agreement.
8.2 In the event of Unforeseen Circumstances, Blue Vibes Bonaire shall be entitled to suspend or terminate the rental agreement, in whole or in part, without being liable for any damages.
8.3 Cancellation or non-performance as a result of Unforeseen Circumstances does not entitle the Tenant to any refund of amounts already paid, without prejudice to the right of Blue Vibes Bonaire to grant a booking credit as a gesture of goodwill.
Article 9 – Liability, Damage and Complaints
9.1 The Tenant and co-users are jointly and severally liable for damage to the vacation home and inventory, unless proven otherwise.
9.2 Blue Vibes Bonaire accepts no liability for theft, loss or damage to persons or property.
9.3 No liability is accepted for failures of utilities, internet, TV or technical installations.
9.4 Complaints must be reported immediately during the stay and submitted in writing within 14 days after departure.
Article 10 – Departure and Final Cleaning
10.1 The vacation home must be left broom-clean.
10.2 Dishes must be clean and stored properly; waste must be disposed of; damage must be reported.
10.3 Additional cleaning or repair costs due to improper use may be charged to the Tenant.
Article 11 – Applicable Law
11.1 All agreements and these General Rental Conditions are governed exclusively by the Civil Code BES.
11.2 Any disputes shall be submitted to the competent court on Bonaire.
